RULES AND REGULATIONS

FOR THE

ENCORE MONROE CONDOMINIUM ASSOCIATION CLUBHOUSE

 

THE CLUBHOUSE IS PRIMARILY FOR THE USE AND ENJOYMENT OF MEMBERS OF THE ENCORE MONROE CONDOMINIUM ASSOCIATION

 

GENERAL RULES AND REGULATIONS

 

 

1.         These rules and regulations are to be applied in a manner consistent with the intent and meaning of the Master Deed and Amendments to the same, as well as any and all duly promulgated resolutions of the Encore Monroe Board of Directors.

 

2.         A Member shall be deemed a person in good standing who occupies a home in Encore Monroe as owner of record or by designation of the owners of record.

 

A guest shall be defined as persons who are on community premises by reason of specific invitation from a Member.

 

Members assume responsibility for the conduct of their guests and temporary residents at all times throughout Encore Monroe.  Temporary residents and guests, while on the premises of the Encore Monroe Community, are bound by all rules and regulations and any violation of the rules and regulations by temporary residents or guests, shall be deemed violations by the Member. 

 

Members and their guests are required to comply with rules as posted in the individual activity rooms, in addition to these general rules and regulations.

 

3.         The hours of operation shall be from 6:00 AM. to midnight, 7 days per week.

 

4.         All residents utilizing clubhouse common areas shall have on their person the appropriate identification consisting of the Encore Monroe key fob or any other means of identification designated by the Board of Directors.  Guests must be accompanied by a member.

 

5.         The clubhouse shall be utilized for educational, social, cultural and recreational programs.  The clubhouse may not be used for any organized religious services. Non-Members shall not be permitted in the clubhouse, unless accompanied by a Member or authorized person, with the required identification.  Children must be under the direct supervision of a Member.

 

No pets shall be permitted on the clubhouse premises, at any time, unless as a handicapped companion. 

 

6.         Smoking shall not be permitted on the clubhouse premises, except in designated outdoor area. 

 

7.         No equipment or items shall be taken from the clubhouse grounds for any reason.  All equipment must be promptly returned, after use, to its storage location.

 

8.         Clubs, committees and groups must schedule their meetings and coordinate the same with the Lifestyle Coordinator.

 

The utilization of the clubhouse facilities by clubs and groups shall take precedent over the utilization by individuals in the event of a conflict.

 

Groups not having assigned days and times for use of the facilities, and Members wishing to utilize the facilities for any purpose other than private rental functions must apply for use of the facility at least ten (10) days in advance for the purpose of scheduling and set up.  Requests shall be submitted to the lifestyle director.  The application may be obtained at the clubhouse from the lifestyle director or management staff member.

 

All applications for private parties must have specifics regarding the utilization of the facilities by the group or Member(s). Types of events for private rentals not permitted are commercial, profit making and organized religious services. Utilization of the facilities shall require approval by an Encore Monroe Clubhouse Committee representative and a Board representative.  In the event liquor is to be served, the committee shall be furnished with a certificate of insurance naming the Encore Monroe Condominium Association as an “additional insured.”  The Certificate of Insurance must specifically provide liquor liability coverage and name the specific event.  Coverage shall not be less than $1,000,000.  No one under 21 years of age shall be permitted to consume alcoholic beverages and the caterer and Member(s) shall be responsible for enforcement of this rule.  Only Members may rent clubhouse space.

 

Fees for utilization of the clubhouse, excluding maintenance and security, shall      be as follows:

 

            a. First Floor Ballroom                                  $500.00                     

b. Second Floor Balcony Room                  $250.00                     

c. Second Floor Front Room

            (Adjoining Balcony Room)                         $350.00                     

d. Balcony and Front Room             $600.00

 

If your private event requires additional set up and/or break down time, i.e., the day before and/or the day after, you will be charged for 2 or 3 Rental days; the day of your event and the day(s) set aside for your set up and/or breakdown.

                       

There shall be a $500.00 refundable deposit for damages.  In the event damages exceed $500.00, the Member shall be responsible.

Off premises caterers must provide proper credentials and present proof of liability and workman’s compensation insurance coverage.  Valet parking shall be an option for the host, however, the valet company must furnish proper proof of insurance, including liability coverage and workman’s compensation coverage.

 

9.         All advertising or notices in the Clubhouse must be approved and posted by the lifestyle coordinator. 

 

10.       Members and their guests (including children) must be properly dressed while on the clubhouse property.  Bathing suits may only be worn in the pool area and shall not be permitted in the clubhouse unless worn under an appropriate covering.  Men must wear shirts in the clubhouse, in the indoor facilities, and bare feet shall not be permitted, other than in the pool areas.

 

In the event that the Café is fully functional, food and drinks shall only be sold by the café facility, except as specifically designated in approved, authorized functions.  Food may only be consumed in areas specifically designated for this purpose.

 

11.             Swimming Pools  -

The New Jersey State Sanitary Code below is the authority on Pool Rules and Regulations.  The State Code does provide for additional Rules and Regulations as are seen fit by the establishment.  Aside from the 11 items listed, Encore Monroe Condominium Association also has additional, enhanced and clarifying rules and regulations that homeowners and guests must comply with.

PUBLIC RECREATIONAL BATHING

         8:26-5.4 Bather rules for swimming pools, wading pools, hot tubs and spas

(a)   Rules governing admission, bathing, and conduct of patrons shall be conspicuously posted and shall include at a minimum the following provisions verbatim:

         Any person showing evidence of any communicable skin disease, sore or inflamed eyes, cold, nasal or ear discharges, or any other communicable disease shall be denied admission.

         Any person with excessive sunburn, open blisters, cuts, or bandages shall be denied admission.

         Do not enter the water if you are experiencing or recovering from diarrhea or have had any signs or symptoms of a gastrointestinal (stomach) disease in the past seven days.

         Children must be at least three years of age and must be toilet trained to use the pool.  No diapers of any kind allowed.  

         Children should be encouraged to use the restroom before entering the water. Immediately report any "accidents" you observe in the bathing waters to a lifeguard.

         No animals, except for service animals, shall be allowed in the swimming pool, wading pool, hot tub, or spa area, dressing rooms, or other parts of the enclosure.

         Glass containers shall be prohibited in food and drink areas.

         All persons shall shower before entering the water.

         Conduct, which endangers the safety and comfort of others shall be prohibited.

         Outdoor bathing shall be prohibited during an electrical storm.

         Persons suspected of being under the influence of drugs or alcohol shall be prohibited from entering the water.

(b)   Policies and procedures regarding water toys and floating devices shall be established to ensure a safe bathing environment.

 

 

 

 

IN ADDITION…

 

CONDOMINIUM ASSOCIATION INDOOR & OUTDOOR POOL & SPA RULES

 (IN ADDITION TO N.J.A.C. 8:26-5.4 Bather rules for swimming pools, wading pools, hot tubs and spas)

 

1.      At no time may you use the pool or spa without a lifeguard present.  The lifeguard has total authority to enforce all rules and may evict anyone not following directions.  No one is allowed to distract the lifeguard in any way.

2.      There will be an ADULT ONLY SWIM for 30 minutes every two (2) hours if the situation warrants.

3.      The Encore Monroe pools are for the use of residents and their guests only.  Residents must be present with their guests.  The lifeguard will not allow any unaccompanied guests onto the pool grounds.

4.      Residents and guests must visibly display their pool badges at all times to enter and remain in the pool area.  POOL BADGES ARE TO BE RETAINED FOR USE IN FUTURE YEARS. Residents and guests must sign in.

5.      Residents are responsible for the conduct of their guests including any damages.

6.      Children must be at least three years of age and must be toilet trained to use the pool.  No diapers of any kind allowed.   No persons under the age of eighteen (18) are allowed to use the spa.

7.      The Association is not responsible for the loss or damage to personal property.

8.      Persons using the pool must wear appropriate bathing attire.

9.      Floating devices such as rafts, boogie boards, etc. are prohibited.  Those devices permitted are floating devices for instructor supervised classes, children with arm “swimmies”, “noodles” and exercise dub-bells.  No objects in pool, which may cause harm such as: balls, water guns or toys.

10.  Loud or unruly behavior will not be tolerated.  The lifeguard will require that the individual(s) leave the pool area and this behavior may warrant suspension of pool privileges.

11.  Portable radios, tape and CD players must be kept low enough not to disturb others and must be lowered upon request.  We encourage the use of headsets.

12.  No diving or jumping into pool.  No running in the pool area or on the clubhouse grounds. No unnecessary splashing or rough play allowed.

13.  No smoking permitted in the pool area.  Smoking permitted only in designated areas.

14.  No food or beverages except water in plastic bottles permitted in the fenced pool area.  Absolutely no glass bottles of any kind allowed anywhere on the outdoor clubhouse grounds.

15.  Tables, chairs and lounges cannot be reserved.  All lounges and chairs must be covered with a towel.  ON WEEKENDS AND HOLIDAYS CHAIRS AND LOUNGES ARE FOR RESIDENTS ONLY.  GUESTS MUST PROVIDE THEIR OWN CHAIRS.  Items cannot be left in the pool area overnight.

16.  Pool furniture is reserved for those members enjoying the outdoor pool and spa.  On busy days, particularly weekends and holidays, tables and chairs within the pool gated area should not be taken by those there solely for the purpose of playing table games.

17.  The Board and their designee(s) may close the pool for maintenance operations, health conditions, safety, weather or any other reasonable cause.

18.  The hours of operation are determined by the Board and are subject to change at their discretion.

19.  The pool will be closed when the lifeguard is testing the indoor pool and for emergency breaks.

 

 

Hours: The hours of operation for the indoor pool shall be 6:00 a.m. until 10:30 p.m. and the hours of operation for the outdoor pool shall be posted each season. 

 

Lifeguard:  In the event a lifeguard is employed, the lifeguard will make decisions concerning the interpretation and enforcement of the State of New Jersey Uniform Bathing Code, the Monroe Township regulations and the Encore Monroe recreation regulations.  Failure to comply with the lifeguard’s instructions may result in eviction from the clubhouse facility.  The lifeguard shall be the sole judge of compliance with the rules and regulations.  In addition, the lifeguards may post additional rules for general safety.

 

In the event a lifeguard is not present during the hours of operation for the indoor pool, any person utilizing the pool facility MAY NOT SWIM ALONE.  Please take special note of the sign in the pool area that is posted in compliance with 8:26-5.2 of NEW JERSEY STATE SANITARY CODE,  CHAPTER IX, PUBLIC RECREATIONAL BATHING (for a specially exempt facility such as Encore Monroe)

“No lifeguard on duty”

“Persons under the age of 16 must be accompanied by an adult”

“No swimming alone”

 

If you fail to comply, you do so AT YOUR OWN RISK.  The Association Board of Directors and Management strongly encourage and support the code above.

 

Other: 

 

Organized pool activities shall take precedent over individual use of both the indoor and outdoor pool.  Persons using the furniture and lounges provided by Encore Monroe must cover the furniture and lounges with a large bath towel before utilizing the same.

 

Diving into the pool, horseplay or running in the pool area is prohibited.  Sitting on the pool steps or ladders, as to hinder entry/exit from the water, is also prohibited.

 

No radios or other music media are permitted in the pool area, except those equipped to play through earphones.

                                   

No pool furniture shall be removed from the pool area.  Pool furniture cannot be reserved.  Lounges and chairs are primarily for residents’ use.  On weekends and holidays, guests must bring their own chairs.

 

Any person showing evidence of skin disease, sore or inflamed eyes, cold, nasal or ear discharge, excessive sunburn, open blisters, cuts, bandages or any communicable disease, should not use the pools.  Anyone using the facility in contradiction to this rule will be assessed the cost to super-chlorinate, drain and clean the pool.

 

SPECIAL NOTE:  When a lifeguard is present, the role of a lifeguard is to attend to the health and safety of the pool patrons.  The lifeguard is not there to police other rules and regulations that are not related to health and safety.

 

 

12.       Spa /Jacuzzi -

                                                                       

                        (a)       Any person utilizing the Spa/ Jacuzzi facility must have at least one “buddy” present to assist them in case of need.

 

                        (b)       Users are required to shower prior to entering the Jacuzzi/spa, in accordance with New Jersey health regulations.

 

                        (c)        Minimum age for use is 18 years.

 

                        (d)       Users shall comply with recommended use and time periods. (10 to 15 minutes)

 

                        (e)       The Spa/Jacuzzi is not recommended for individuals with diabetes, high blood pressure, low blood pressure and for those individuals who experience adverse reaction to hot environments.  All users of the Jacuzzi/spa facility do so at their own risk.  In addition, use by pregnant women is not recommended.

 

                        (f)         Any person showing evidence of skin disease, sore or inflamed eyes, cold, nasal or ear discharge, excessive sunburn, open blisters, cuts, bandages or any communicable disease, should not use the Jacuzzi/spa.  Anyone using the Jacuzzi/spa in contradiction to this rule will be assessed the cost to super-chlorinate, drain and clean the Jacuzzi/spa and/or pool, if necessary.

 

                        (g)       The members of the clubhouse committee and/or management will from time to time monitor the utilization of the pools and spas for adherence to regulations.  Members shall cooperate with the committee members and management as respectfully requested.

 

 

 

 

13.       Fitness/Exercise Room -

 

                        (a)       A thirty-minute equipment use time should be adhered to when people are waiting to use equipment.  A sign in list shall be placed in the fitness/exercise room to monitor the wait and equipment time usage for each piece of equipment.  If a Member’s name is on the sign in list, the Member must be present when the equipment becomes available.  If the Member is not present, the use of the equipment will go to the next person on the designated list.

 

                        (b)       Members will be permitted to have adult guests in the Exercise Room between the hours of 11:00 a.m. and closing.  The guest must be accompanied by the Member at all times.  Persons utilizing the equipment, guests and Members, will utilize the same at their own risk.  In addition, the guest will be required to relinquish the exercise equipment they are utilizing, within five minutes of a request by a Member, for use of said equipment.

 

Members will be fully responsible for any damage caused by their guests, as well as any injuries suffered by their guests, while in the Clubhouse.  Guests must abide by all Clubhouse Rules and Regulations and must be at least 18 years of age.  Guests must be accompanied by a Member at all times.

 

                        (c)        Sneakers must be worn at all times in the fitness/exercise room.  All bags, garments, packages, etc., must be stored in the appropriate locker room or coatroom. 

 

                        (d)       The members of the clubhouse committee and/or management will from time to time monitor the utilization of the fitness/exercise room for adherence to regulations.  Members shall cooperate with the committee members and management as respectfully requested.

 

                        (e)       The hours of operation of the fitness/exercise room shall be from 6:00 a.m. until 11:00 p.m. The last Member leaving the fitness/exercise room must insure that the television, lights and fans are shut off.

 

(f)          Persons using any equipment shall wipe down the equipment with a      sanitary wipe after their use of the same.

 

                        (g)       No food is allowed in the fitness/exercise room.

 

14.       Tennis Courts -

 

                        (a)       Only Members may reserve a tennis court.  Play for both singles and doubles is limited to one 1 ½ hours, unless there are no players waiting to utilize the courts.  The tennis courts shall be open for play between 7:30 a.m. and dusk.  Proper ID will be required at all times.

 

                        (b)       A reservation system will be used every day during the hours of 8:00-9:30 a.m.; 9:30 -11:00 a.m.; 11:00-12:30 p.m.; 5:00-6:30 p.m. and 6:30-8:30 p.m.

 

Members may only reserve ONE session during these time periods.

 

Only doubles may reserve time during the hours of 8:00-9:30 a.m.; 9:30-11:00 a.m. and 5:00-6:30 p.m.

 

The hours of 12:30-5:00 p.m. will be available on a first come-first serve basis.  You may continue to play if no one is waiting.  If players arrive and you have played for 1 ½  hours, please vacate the courts.  A time sheet will be placed at the courts.

 

                        (c)        A reservation system will be in place utilizing a lottery for possible time conflicts.  Members may make reservations up to 2 days in advance and must list all names and phone numbers of individuals participating during the time period.  The lottery will take place in the evening 2 days before the playing day and the schedule will be posted on the clubhouse and/or tennis bulletin board.  Any slots still open may be reserved up to and including the playing day.

 

                                    The Tennis Club can reserve courts in advance for organized Encore Monroe tennis functions, i.e., Round Robins, Singles and Doubles Tournaments, organized Men’s and Women’s League play versus other adult communities, etc.

 

                        (d)       At least 3 players for doubles or 2 players for singles must be present for their reservation. If not present after 10 minutes, their reservation will be forfeited and another group may use the court.

 

                        (e)       Players leaving the courts at the termination of their scheduled time cannot be part of a singles or doubles group coming onto the courts.  There must be a break before their utilization of the courts once more.  In other words, consecutive use of the courts by Members with different groups is prohibited so as to maximize the availability of the courts.

 

                        (f)         The courts will be used for tennis only.  Only participating players are allowed on the courts.  Food, smoking, radios are prohibited.  Beverages in plastic unbreakable containers are allowed.  Players are responsible for leaving the courts completely free of debris.  Shirts and tennis shoes are required.

                       

                        (g)       No guest shall be permitted to play during reserved times unless courts are vacant.  A guest shall not be permitted to utilize the tennis courts unless a Member is participating or present.  Members are responsible for the actions of their guests.

 

            (h)        Common tennis courtesies must be observed and any controversies should be referred to a member of the tennis committee for resolution.

 

 

 

15.       Shuffle Board, Bocci Ball and Putting Green

 

                        (a)       These facilities are for the use of Members and their guests only. Guests must be accompanied by Members at all times.  Appropriate shoes must be worn at all times and bathing suits are not permitted in these areas.  Shirts are required at all times.

 

                        (b)       Keys for the equipment are available at the Gatehouse and must be signed out.  Equipment must be returned to the proper storage area and the key must be returned to the Gatehouse.

 

(c)         These facilities are to be used for the intended purposes only.  The use of this equipment shall be further regulated by the rules posted at the activity location.

 

16.       Billiards Room-

 

(a)               Guests must be accompanied by a resident and must be at least 16 years of age or older.

(b)               Coats and jackets must be hung up in the coatroom.

(c)               Cue sticks and bridges must be returned to the rack.

(d)               Consideration must be given to others waiting for a table.

(e)               Anyone causing damages to tables, equipment or furnishings will be held responsible.

(f)                 Pool Tables must be covered when leaving the room.

(g)               Lights must be shut off when leaving the room.

 

17.                                     Table Games-

 

(a)            Ping Pong tables should only be opened and closed by designated personnel and remain in designated areas.  The tables require specific handling to be opened and closed.  An untrained individual will damage table.  When at all possible (if there is not a scheduled event), the ping pong tables will opened and available for play on weekends

 

(b)            After playing any game, including cards, maj jong etc. please police your area and return tables and chairs to the card room areas.

(c)             When playing mah jongg, please cover tables to prevent scratching caused by tiles.

(d)            All food and garbage should be removed and placed into appropriate receptacles

(e)            Be respectful of your neighbors in playing areas.

(f)               Card games etc. are restricted to designated areas on the 2nd floor only unless cleared with the lifestyle coordinator or community manager.

 

 

18.       Arts and Crafts Room -

 

                        (a)       Utilization of the arts and crafts room is restricted to the Members.

 

                        (b)       Aerosol spraying shall not be permitted in the clubhouse, including the arts and crafts room, at any time.  All materials necessary for construction of a project must be furnished by the Member or the instructor.

 

                        (c)        Any damage must immediately be reported to the lifestyle coordinator.  Spills must be cleaned up immediately and any equipment utilized must be cleaned and placed in its normal storage area upon completion of the utilization of the equipment.

 

                        (d)       The sink and clay-trap rules must be adhered to.

 

                        (e)       The lifestyle coordinator shall be responsible for scheduling arts and crafts classes.

 

    

     19. Business Center-

 

Computers and printers are for resident use only.  Residents must supply their   own printer paper.

 

20.             Telephone Usage-

     

Telephone usage should be limited to emergency use only.  Directions for accessing 911 are above each phone in the Clubhouse.

 

21.             Violations  -

 

Violations to the Clubhouse Rules and Regulations shall be handled as all other violations to the governing documents of Encore Monroe Condominium Association.

 

22.             Parking

 

When parking at the Clubhouse to attend an off site event, please park in the spaces furthest from the Clubhouse entrance. 

 

Also, please park head in.  Parking otherwise creates the emission of car fumes to stream directly to shrubbery and the building.
